Abstract

This article presents a comprehensive analytical and critical study of the Constitution of Medina, recognised as the first written constitution in the human history. Drafted under the leadership of the Prophet Muhammad (blessings and peace be upon him) following his migration to Medina from Mecca, this document established a pluralistic, inclusive civic state grounded in justice, mutual responsibility, religious freedom, integration and social unity. Through Qur’anic injunctions, authentic Prophetic traditions, and early historical sources such as Abu Ubayd b. al-Qasim b. Sallah, Humayd b. Zanjawayh, Ibn Hisham, al-Tabari, and Ibn. Kathir, the article demonstrates that this constitution was not merely a political accord, but a normative Islamic charter integrating diverse religious and tribal communities—such as Meccan Emigrants, Medinan Helpers and non-Muslims—into a unified polity.

            The study verifies the constitution’s provisions with verses of the Qur’an and hadith, highlighting their direct textual and conceptual harmony. Particular focus is given on intercommunal harmony, minority rights, due process, individual accountability, collective security and the legal autonomy of all faith groups, where all citizens were guaranteed the protection of their beliefs, lives, property, and social rights. The constitution’s enduring relevance is evaluated in light of contemporary global debates on social contracts, minority protection, and interfaith coexistence.

            The article proves that the Constitution of Medina remains an exemplary model for interfaith harmony, religious freedom, civic equality, and state partnership. By critically engaging classical and modern scholarship—both Islamic and orientalist—the article affirms the Constitution of Medina as a foundational model of Islamic governance, legal pluralism, and ethical statecraft. The study concludes by asserting the document’s timeless applicability in modern multi-faith societies and the urgent need for Muslim polities to revive its core principles of justice, unity, and mutual respect.
